On May 25, 1999 Governor Pataki signed into law Chapter 49 of the Laws of 1999 establishing the New York Black Car Operators’ Injury Compensation Fund, Inc. (the "Fund"). On September 13th we received notification from NYS Division of Licensing Services as well as the Fund along with a copy of Executive Law, Article 6-F, and the Fund’s plan of operation that was promulgated on September 7, 1999.

As of October 1, 1999 each Central Dispatch Facility will be required to assess a surcharge of 2% on all billings, invoices, and credit charges for services provided to its customers. All black car and limousine dispatch bases providing transportation services in New York State are mandated to separately charge, collect, and remit to the Fund a surcharge of 2% on gross billings for "Covered Services." Under the Law "Covered Services" means:
  • Dispatches from or by a Central Dispatch Facility located in the State of New York regardless of where the pickup or discharge occurs; and
  • Dispatches by a Central Dispatch Facility located outside the State of New York involving a pick up in the State of New York, regardless of where the discharge occurs.
The proceeds of this surcharge will be administered by the Fund to secure the payment of workers compensation for claims made by black car and limousine operators who are injured while providing service.

Gross billings refers to all charges included in total amount: i.e., transport charge, tolls, wait time, telephone, STOPS, parking, tips, etc. The 2% surcharge will be assessed against all charges billed to customers. However, all cash rides or cash tips will not be assessed the 2 % surcharge.
